It is essential to understand that when an Indian citizen marries a foreign national in India, local marriage registrars frequently demand a No Objection Certificate (NOC) or a Certificate of No Impediment (CNI) from the foreign partner to prove his/her eligibility to marry.
As I already told in my previous video, that NOC or CNI is issued by concerned embassy of foreign national country in India but what if your embassy refuses to give the required NOC or CNI OR in a case where your concerned Embassy is not issued NOC. In such circumstances, the main question arises that “Does the foreign national have any remedy or alternative to get married in India? Or can the foreign national partner get married in India without NOC ? The answer is Yes.
There are three essential remedies you must know to avoid legal hurdle in your marriage.
Single Status Affidavit / Certificate of Marital Status:
The foreign national is required to prepare a self-declared affidavit stating his/her name, age, and marital status (i.e. the foreign national is single, divorced, or widowed and legally eligible to marry) with passport details.
Certificate of Marital Status is issued by local municipal govt. body, vital statistics office, of a court in the foreign national’s home country.
To make the affidavit or status certificate valid in India – The foreign national is required to get the affidavit or certificate apostilled OR these documents can be legalized by the Indian Embassy in that country.
Formal Representation by a legal expert-
If the concerned marriage registrar refuses to cooperate without an NOC, then take help from legal professional or lawyer (who is expert or experience in foreign marriage) for Formal Representation. Here, Formal Representation is a kind of official request to consider the Singal Status Affidavit or Certificate of Marital Status of your foreign national home country with detailed explanation of precedent/courts’ judgments passed by the respective High Court or Supreme Court of India to accept alternative documents in place of NOC.File a Writ to High Court-
If the Marriage Registrar rejects your marriage application despite your formal representation or make indefinite delay in your application, then the last and final remedy is to approach concerned High Court in India by way of a “Writ of Mandamus” that is constitutional litigation.
Writ is expeditious litigation that provide immediate judicial relief. You will happy to know that the High Cour won’t take much time provide judicial relief.
Lastly, It is crucial to know that the requirement of NOC is an administrative procedure where the concerned marriage registrar asks the required NOC to process your marriage application. It means the NOC is nowhere mentioned in the Special Marriage Act. The requirement of NOC by the Marriage Registrar is merely to verify the eligibility of the foreign partner whether your foreign partner is free to marry or not.
In a certain situation where the foreign national partner is unable to give NOC but have another alternative documents which show that the foreign partner is single and eligible to marry then the Marriage Registrar is required to accept the alternative documents provided the alternative documents satisfy the core statutory requirements.
Important Advisory
Please do not rush into marriage-related decisions based on information from social media, agents, or unofficial sources. Every case is different, and the legal requirements may vary depending on the nationality of the foreign partner and the concerned Marriage Registrar.
If your Embassy refuses to issue an NOC or does not provide one, it does not necessarily mean that your marriage in India is impossible. There may be alternative legal options available depending on your circumstances.
Always seek advice from an experienced lawyer in India who handles foreign marriage matters. Most importantly, stay away from touts, unauthorized agents, and people who promise quick solutions without proper legal guidance.
